Electronic Signature and Electronic Records Consent

This consent applies to Customers, Authorized Users, sellers, vehicle owners, representatives, and other persons who electronically sign or receive records through Lkota.

Federal law generally recognizes electronic records and signatures and includes specific consent and record-access requirements when legally required written disclosures are delivered electronically to consumers.

1. Consent to electronic records

By clicking “I Agree,” “Accept,” “Continue,” “Sign,” or a similar button, the signer consents to:

• receive documents electronically;
• review documents on a computer or mobile device;
• use an electronic signature;
• receive notices by email, text message, account notification, or web display;
• download and retain electronic documents; and
• conduct the transaction electronically.

2. Legal intent

The signer intends an electronic signature, typed name, drawn signature, click, checkbox, verification code, or other electronic action to have the same intent and effect as a handwritten signature, to the extent permitted by law.

3. Hardware and software requirements

To receive and retain electronic records, the signer must have:

• internet access;
• a current web browser;
• a functioning email address or telephone number;
• a device capable of displaying records;
• software capable of opening PDF files; and
• sufficient storage or printing capability to retain copies.

4. Access and retention

Before signing, the signer confirms the ability to:

• access the document;
• read the document;
• download or save the document; and
• print the document or otherwise retain a copy.

Lkota may provide a downloadable copy after signing.

5. Paper copies

A signer may request a paper copy by contacting:

Reasonable printing and delivery charges may apply if disclosed before fulfillment.

6. Withdrawal of consent

A signer may withdraw consent for future electronic records by contacting Lkota.

Withdrawal:

• applies prospectively;
• does not invalidate previously signed records;
• may delay a transaction;
• may prevent continued use of electronic-signature features; and
• may require completion through paper documents.

7. Updating contact details

The signer must maintain a current email address and telephone number and notify the relevant Customer or Lkota of changes.

8. Electronic evidence

The signer agrees that Lkota may retain evidence relating to the signature process, including:

• document version;
• signature image;
• typed name;
• timestamp;
• IP address;
• device information;
• authentication method;
• confirmation code;
• audit log; and
• document hash.

9. Required acknowledgment

I consent to use electronic records and signatures. I confirm that I can access, read, download, and retain the documents presented to me. I understand that my electronic signature is intended to bind me to the same extent as my handwritten signature.
