VIN Report and NMVTIS Disclaimer

This disclaimer applies to all vehicle specifications, title information, odometer information, theft records, lien records, auction information, salvage information, recalls, valuations, emissions data, and other vehicle information presented through Lkota.

1. Third-party information

Vehicle information is obtained from third parties and may include information from ClearVin, NMVTIS-related sources, state motor-vehicle agencies, law-enforcement-related sources, lien databases, auctions, insurers, recyclers, salvage yards, manufacturers, and other providers.

Lkota does not create or independently verify all such information.

2. Information may be incomplete

A vehicle report may not contain:

• all title records;
• all state records;
• all liens;
• all theft reports;
• all accidents;
• all repair history;
• all damage;
• all salvage events;
• all auction events;
• all odometer events;
• all recalls; or
• all ownership disputes.

Information may be delayed because a responsible person, business, government agency, lienholder, insurer, junk yard, salvage yard, or other reporting entity has not yet submitted or updated a record.

3. Meaning of a negative result

A negative result means only that no matching record was returned from the checked source at the report time.

The following results are not guarantees:

• “No Record Found”
• “No Active Theft Record Returned”
• “No Open Lien Record Returned”
• “No Title Brand Returned”
• “No Odometer Problem Returned”
• “No Salvage Record Returned”

Such a result does not establish that:

• the vehicle is not stolen;
• the vehicle has no lien;
• the title is valid;
• the seller owns the vehicle;
• the seller has authority to transfer the vehicle;
• the odometer is accurate;
• the vehicle has no damage;
• the vehicle may lawfully be purchased; or
• the vehicle may lawfully be towed, transferred, dismantled, or sold.

4. No official clearance

A Lkota or ClearVin report is not:

• law-enforcement clearance;
• a lien release;
• a certificate of title;
• an ownership document;
• a government authorization;
• a physical inspection;
• an appraisal guarantee;
• legal advice; or
• a substitute for official verification.

5. Required verification

Before completing a vehicle transaction, the user must independently verify:

• the VIN displayed on the vehicle;
• the VIN on the title;
• the seller’s identity;
• the seller’s ownership or authorization;
• title status;
• lien status and any required lien release;
• theft status;
• title-transfer eligibility; and
• required government filings.

6. Responsibility for decisions

The user and the user’s business are solely responsible for final decisions concerning:

• purchase;
• payment;
• towing;
• possession;
• storage;
• dismantling;
• recycling;
• transfer;
• export; and
• resale.

Lkota does not make or approve the user’s final vehicle-transaction decision.

7. ClearVin release

To the maximum extent permitted by law, the user waives and releases claims against ClearVin, its licensors, and underlying data providers arising from the user’s use of or reliance on ClearVin Licensed Materials.

8. Required per-report acknowledgment

Before the first VIN check, and whenever Lkota reasonably requires renewed acceptance, the user must affirm:

I understand that this vehicle report may be incomplete, delayed, unavailable, or inaccurate. A negative theft, lien, title, salvage, or odometer result is not legal clearance or a guarantee. I am responsible for independently verifying the vehicle, seller, title, ownership, lien, and theft status before completing a transaction.
